General terms and conditions (GTC) — online shop

1. Scope

1.1 These general terms and conditions apply to all orders for goods and products offered via the online shop on this website.

1.2 The contractual partner for the sale of goods is exclusively:

1.3 Divergent customer conditions do not apply unless the seller expressly agrees to their validity in writing.

1.4 The offer is aimed both at consumers within the meaning of the Consumer Protection Act (KSchG) and at entrepreneurs within the meaning of the Companies Code (UGB).

2. Subject matter of the contract

2.1 The subject of the contract is the sale of goods, in particular tactical emergency and first aid equipment and accessories.

2.2 The main characteristics of the goods are derived from the respective product description in the online shop.

3. Conclusion of contract

3.1 The presentation of the products in the online shop does not represent a legally binding offer, but a non-binding invitation to place an order.

3.2 By completing the order process (clicking on “Buy now”, “Checkout” or comparable buttons), the customer submits a binding offer to conclude a purchase contract.

3.3 The contract is concluded as soon as the seller confirms the order by e-mail or the goods are shipped.

4. Prices and Payment

4.1 All prices are in euros. Unless expressly stated otherwise, prices include statutory sales tax.

4.2 Payment is made using the payment methods offered in the shop (e.g. credit card, instant transfer, Apple Pay, Google Pay or other Stripe payment methods).

4.3 The means of payment will be charged immediately upon completion of the order.

5. Delivery and Dispatch

5.1 Delivery is made to the delivery address specified by the customer.

5.2 Delivery times, shipping costs and any restrictions are based on the information in the ordering process and on the “Shipping & Delivery” page.

5.3 Partial deliveries are permitted insofar as this is reasonable for the customer.

6. Transfer of risk

6.1 For consumers, the risk of accidental loss and accidental deterioration of the goods only passes over to the customer.

6.2 In the case of entrepreneurs, the risk is transferred to the shipping service provider when the goods are handed over.

7. Right of withdrawal (consumer)

7.1 Consumers are generally entitled to a statutory right of withdrawal in accordance with the Distance and Outward Transactions Act (FAGG).

7.2 Details can be found in the cancellation policy in the online shop.

8. Returns and refunds

8.1 After exercising the right of withdrawal, the customer must return the goods to the seller immediately, but no later than within 14 days.

8.2 The direct costs of returning the goods are borne by the customer, unless otherwise agreed.

8.3 The refund will be made using the original means of payment.

9. Guarantee

9.1 The statutory warranty provisions apply.

9.2 For entrepreneurs, the warranty period is 12 months from delivery of the goods, to the extent permitted by law.

10. Product information and liability

10.1 Some of the products offered are medical aids or emergency products. These do not replace medical advice or treatment.

10.2 The seller assumes no liability for damage caused by improper use or storage of the products.

10.3 Product liability under the Product Liability Act remains unaffected.

11. Retention of title

The goods remain the property of the seller until full payment has been made.

12. copyright

All content, texts, images and product descriptions in the online shop are protected by copyright. Use without express consent is prohibited.

13. data protection

Information on the processing of personal data is regulated in the privacy policy. Personal data is transmitted to Stripe for payment processing.

14. Final provisions

14.1 Austrian law applies to the exclusion of the UN sales law.

14.2 The place of fulfilment is the seller's registered office.

14.3 For entrepreneurs, the place of jurisdiction is the competent court at the seller's registered office.

14.4 Should individual provisions of these terms and conditions be or become invalid, the effectiveness of the remaining provisions remains unaffected.
